Claims Management & Dispute Resolution • Lead the review and assessment of Contractor claims, applying rigorous chronological analysis of events, correspondence logs, as-built schedules, and contemporaneous records. • Prepare Recommendation Reports for Employer consideration and assist in negotiations and amicable settlement. • Support Expert Resolution and court proceedings where disputes escalate. • Take proactive steps to prevent and mitigate claims through strict adherence to contract provisions.???? Variations & Change Management • Administer the full Variation Order lifecycle, including Pending Variation Orders (PVOs), Site Work Instructions (SWIs), and formal Variation Orders. • Manage Value Engineering proposals from Contractors, including determinations of resulting price adjustments. • Oversee Provisional Sums expenditure instructions, Daywork variations, and Changes in Legislation adjustments. • Ensure all variations comply with contractual notification timelines to protect the Employer from exposure.???? Subcontractor & Supply Chain Contracts • Manage consent to subcontractors, review of Collateral Warranties, and instructions on Nominated Subcontractors. • Administer payments to Nominated Subcontractors, including certification and instructions to withhold or pay directly where required. • Review and manage assignment of subcontract benefits to the Employer where applicable.???? Suspension, Termination & Force Majeure • Manage contract suspension processes, including determinations of time and cost entitlement. • Administer Termination by Employer, Termination by Contractor, and Termination for Convenience procedures. • Manage Force Majeure notices, determinations, and certifications. • Ensure orderly phasing down, securing of site, protection of completed works, and finalization of accounts in termination scenarios.???? Insurance, Bonds & Performance Securities • Oversee receipt, return, and management of Performance Securities and Advance Payment Guarantees. • Manage the Retention, Insurance and Bond Register, ensuring all policies are current, compliant, and renewed 3 months in advance of expiry. • Ensure no Application for Payment is certified without valid insurances and bonds in place.???? Completion, Defects & Final Account • Administer Taking-Over Certificates, Sectional Completion Certificates, and Performance Certificates. • Manage the Defects Notification Period (DNP), including close-out of Contractor defects and liaison with Operators for newly identified defects. • Oversee Final Payment Certificate issuance, including setoffs for deficiencies and retention release. • Contribute to the Project Final Report with a comprehensive summary of contractual issues, variations, and claims.???? Contract Documentation & LOA Process • Collate Letter of Award (LOA) prerequisite documents and complete the LOA Prerequisite Documents Checklist. • Compile full sets of Contract Documents for Contract Execution. • Manage document workflows via Aconex for LOA and contract-related approvals.????
