- Assist and provide active support to Head of Contracts (HOC) for effective formulation and implementation of Contract & CommercialManagement processes and strategies.
- Pre-award review of tender and Contract & Commercial documents from the contractual and legal viewpoint.
- Drafting of Contract Documents includes but not limited to Agreements, Subcontracts, Conditions of the Contract, Memorandum of Understandings (Mo Us), Joint Venture (JV) and Consortium Agreements, Amendments.
- Drafting of Contractual correspondence.
- Drafting of position paper and executive summaries in relation to claims, disputes and other contractual issues.
- ·Prepare & Present monthly Cost Value Reconciliation (CVR) to compare actual costs against budgeted costs and revenue.
- ·Prepare and submit timely invoices per contract terms, track submissions, resolve discrepancies, and ensure prompt payments to the Employer.
- Review, verify, and approve invoices to the Subcontractors based on compliance with contract terms and project progress; ensure timely payment to maintain good relationships and project continuity.
- Prepare and submit detailed documentation for variation orders, including cost estimates, justifications, and any necessary approvals
- Prepare and Manage cash flow, including the timely collection of receivables and payments to subcontractors.
- Leading quarterly Contractual audits on assigned projects and preparing contractual audit reports.
- Resultant to contractual audits, issue Corrective Action Requests (CARs) to the concerned Project Manager and monitor and follow-up the CAR till closure.
- Provide contractual and legal input regarding the best modality for the Contracts, Subcontracts, Purchase Orders etc.
- Supervising the Contracts Engineers in the Administration and management of assigned contracts.
- Maintain contractual records and documentation such as receipt and control of all contract correspondence, contracts, contractual changes, status reports and other documents for all projects.
- Provide contractual support to the other departments and Projects during the startup, implementation and close-out of the Project.
- Supporting HOC in-contract negotiations with clients, joint venture partners, governmental entities, sister companies and other corpora
entities.
- Supporting site-based Contract Engineers / Administrators in performance of their duties by reviewing and vetting their work.
- Supporting HOC in the Dispute Resolution processes on behalf of the Company.
- Analyze contractual and legal problems and propose solutions to the HOC on how to resolve these problems.
- Supervision and capacity building of assigned Contracts Engineers.
- Ensure that copies of the signed contracts are communicated to all relevant departments to provide contract visibility, awareness and interpretation to support implementation.
- Monitoring contracts and moving forward with close-out, extension or renewal of contract.
- Supervise that the signed contracts, correspondence and other documentation related to
contracts have been securely maintained.
- Supervise the circulation the copies of the Signed Contracts to the other concerned departments and the respective Project.
- Drafting Amendments to the signed Contracts.
- Any other task that may be identified by HOC, CEO or Management.
