The Commercial Director will manage and lead the commercial, contractual, financial services and administration during a tender and delivery stage in KSA or MENA region.
The Commercial Director will produce project reporting to meet management and statutory commercial requirements.
Key Skills
Advanced skills in procedures for project contract administration, general business administration and project management
Reporting and compliance with respect to commercial performance and legislation/code/ Security of Payments Act to prevent potential business exposure.
Comprehensive understanding and experience in entire life cycle of infrastructure construction including but not limited to construction bid, contract, preconstruction, procurement, project delivery and DLP.
Interpretation of the tender and the application of the commercial and contractual agreement at Main Contract, Sub Contract and JV/Consortium level.
Skill in quantitative and qualitative risk assessment and development of risk controls and actions involved in bidding and implementation of projects
Understand scope of works for the project and regions and business units and each subcontracted section of works including the ability to interpret drawings and specifications
Awareness of policy and application of Corporate Limits of Liabilities and contractual and commercial systems, processes and procedures
Understand contractual requirements and stakeholder expectations
Understand requirements of leases and/or licences and ensure administrative compliance
Knowledge of records management procedures and record, register and version control
Understand scope of work and knowledge of project management structure, plans and implications for contract and commercial accountabilities
Detailed understanding of the tender (methodology, costings and constraints), contractual agreement, claim and dispute management at Main Contract, Sub Contract and JV/Consortium level and Corporate Limits of Liabilities
Operational Delivery
Ensure that all project staff are formally aware of their commercial responsibilities whilst on the project
Promote project commercial capability by participating in the development and continual improvement of related behaviours and systems
Provide leadership and management of staff and ensure alignment between team capability and the business objectives
Encourage an environment of sharing knowledge and ideas to support continuous improvements within the team
Mentor commercial team to further develop their understanding of relevant project commercial systems and processes
Lead a professional and effective team, capable of high standards of performance in which individuals are held accountable to deliver against set objectives and are rewarded accordingly
Ensure that clear performance objectives are in place for the team, measure and manage progress against objectives and provide and obtain regular feedback and coaching and mentoring
Overall accountability for the set-up, scope development and review of consultants, sub-contractors, supply packages
Jointly manage commercial and contractual risk and opportunities
Ensure commercial team understands Rights & Obligations with particular emphasis on notice periods, time bars and follow-up actions
Ensure the project team understand their responsibilities in relation to identification, notification and processing
Promptly attend to and manage claims/disputes and referral to Project Director and Contracts Manager.
