MEETKSADhahran Job Description and Qualifications PRINCIPAL DUTIES AND RESPONSBILITIES:
- The development and implementation of Project contracting strategy
- Develop negotiate and manage all commercial agreements/contracts to mitigate risk and optimize opportunities.
- Mitigate project expenses without compromising quality.
- Provide ongoing commercial/contract support ensuring commercial practices comply.
- Support the pre/post contracts awards process
- Competent understanding of contract(s) and the required administration thereof.
- Ensure contracts staffing requirements both numbers and quality are adequate to meet project requirements.
- Utilize professional experience to verify oversee negotiate and/or approve commercial agreements with clients and third parties.
- Comply with Lines and Limits of Authority.
- Analyze and report on complex situations and potential opportunities/risks of Variations to cost and schedule.
- Provide forward impact analyses and budgetary reporting internally and externally.
- Ensure that Procedures are followed and suggest changes if there is scope for improvement
- Maintain good relations and facilitate exchange of information between company and contractors and internally to assure alignment of strategic objectives.
- Lead and ensure the effective collation of data and information provide analyses and reporting in a timely and periodic manner.
- Review contract specifications works with Stakeholders (PM/PD) to identify risks or gaps in the Project Plan and support PM in the development and implementation of Risk Management Plan
- Ensure for each Project that there is a proper 1) business case 2) risk management and 3) compliance component
- Analyze monthly progress situations against previous forecasts to understand trends
- Support the Project Director in analysis and decisionmaking regarding milestones and invoicing
- Prepare feasibility studies with recommendations on costeffective measures
- Proactively manage and enact the change control process to agreed quality and timescales in order to maximize the commercial and operational benefit to the Program
- Ensure that Projects proceed with respect to the agreed contractual / optimal deadlines (giving ample notice to the main Functions involved so that timely recovery strategies can be devised)
- Maintain commercial tools such as key bidding documents and Proposal templates post award updated and logically structured so that they are readily available as required
- Fully understand and consequently brief relevant parties on the interpretation of the commercial obligations on both the Contract and the Client and the commercial/contractual impact of any failure to achieve these obligations
- Be an active member in the crossfunctional project team liaising with Engineering Procurement Operations and other Functions; identify potential areas of concern and resolve them before they become issues
- Interface with Finance department to develop best financial metrics in relation to bonds payment and bank guarantees
- Follow and comply with Company Project and Project Controls Department procedures and techniques suggesting updates or integrations deemed beneficiary
- Ensure good practice and strict controls are implemented in relation to change orders variations claims etc. (including the assessment of fee claims and advising on dispute resolution)
EDUCATION AND EXPERIENCE: - 10 Years working experience
- Preferable; 3rd Level qualification in Quantity Surveying Economics Business Engineering Accounting or related disciplines
- Industry Sector Experience Oil & Gas Energy Industrial Gases
- Contractual Form(s) experience
- Extensive technical comprehension of Construction & EPC jobs and markets of the industry (ideally in Oil & Gas & Industrial Gas sectors)
- Competent knowledge & understanding of contract law and commercial/contracts management
- Ability to quickly assimilate and retain data and information
- Versatile with ability to grasp broad variety of issues (technical and economic) that span from risk management to procurement financial reporting and management of the supply chain
- Flexibility and capability of identifying solutions
- Demonstrated awareness to details in commercial agreements and implications in highly complex environments (impact on schedule early identification of risks and opportunities).
- Commercial writing skills to illustrate briefly clearly and exhaustively the facts the points of friction/misunderstanding the probable outcome of such situation/behavior and the suggested solutions (addressing Client Subcontractors and Vendors partners and colleagues).
- Ability to work with or without legal resources to draft contract clauses which capture the essential commercial issues of any situation
- Conversant with operating in a Functionally structured organization.
- Analytical skills associated with developing and utilizing performance measures and cost savings
COMPETENCIES: - Not limited to Excel Word Outlook PowerPoint Access for the purpose of information retrieval in spreadsheets word processing of documents and contracts and presentations of goals and results
- Excellent knowledge of system and application for the construction and engineer industry eg. Cost Control Systems DMS and Planning tools
- Strong management and team leadership expertise (preferably with experience in Managing and Leading a multicultural group)
- Ability to work in a multicultural environment
- Developed negotiating skills (with both internal and external counterpart)
- Ability to influence motivate mentor and build relationships
- Strong sense of responsibility with a professional attitude and reputation
